Crosstalk
Be diligent about keeping crosstalk to a minimum during the deposition.
The final transcript needs to contain every word spoken at the proceeding. To capture an accurate record of the proceeding participants must speak one at a time while on the record.
Some overlapping is normal in natural speech patterns (witnesses jumping in with an answer, or an objection starting before the question is complete). However, if participants are intentionally talking over each other, cutting each other off, or rapidly arguing, it is the reporter’s responsibility to continue interrupting with reminders.
All parties must speak one at a time to capture an accurate record.
